Terms and Conditions – New Etihad BusinessConnect
Introduction
These Terms and Conditions form the basis of the Etihad Airways' BusinessConnect programme. They apply to the relationship between Etihad Airways (“Etihad”) and the members of Etihad BusinessConnect. It is your responsibility to read and understand them. They contain very important information about your rights and obligations, as well as limitations and exclusions that may apply to them. The definitions are set out at the end of these Terms and Conditions. These Terms and Conditions are effective as at the date of publication and may be changed/modified by Etihad Airways at any time without any notice. By accepting these terms and conditions, you accept all terms and Etihad’s ability to change them at any time without notice. Please make sure to review the terms and conditions regularly to stay updated.
2. Membership
2.1. Enrolment
2.1.1. Application to join Etihad BusinessConnect acknowledges affirmative acceptance of all Terms and Conditions of the said programme.
2.1.2. Subject to local laws, application to join Etihad BusinessConnect is open to any organisation except where:
2.1.2.1. The applying organisation (“Organisation”), or any party connected to it, is already member of another Etihad BusinessConnect account, sales incentive, discount or any other type of corporate deal or agreement.
2.1.2.2. The applying organisation is a Travel Agency or in related business of selling or bartering airline tickets.
2.1.2.3. The applying organisation is based in a country where Etihad BusinessConnect is not available. (Etihad BusinessConnect is currently available in the following countries - Australia, Austria, Bahrain, Belgium, Canada, Egypt, France, Germany, Greece, Hong Kong, India, Indonesia, Ireland, Italy, Jordan, Kuwait, Lebanon, Malaysia, Morocco, Netherlands, Oman, Pakistan, Philippines, Republic of South Africa, Republic of Korea, Russia, Saudi Arabia, Singapore, Spain, Sri Lanka, Switzerland, Thailand, Turkey, United Arab Emirates, United Kingdom and United States. This list is subject to change at any time without notice).
2.1.3. Membership to Etihad BusinessConnect is open only to corporate or similar organisations, registered appropriately in local jurisdictions. It is not open to individuals, clubs, groups or other entities. Etihad reserves the right to reject or cancel membership at any time without notice at Etihad’s exclusive election. Etihad reserves the right to reverse ineligible Etihad Guest Miles from a member’s account in accordance to 2.2.
2.1.4. Etihad BusinessConnect membership is not transferable.
2.1.5. To apply for membership to the Etihad BusinessConnect programme, an Organisation must complete the Registration Form on etihadbusinessconnect.com and provide all mandatory details as required.
2.1.6. During registration an Organisation will be asked to nominate one employee as an Account Manager on behalf of the Organisation. The Account Manager will be responsible for managing the corporate account and for redeeming Etihad Guest Miles from said account. The Organisation warrants and agrees that the Organisation has the requisite written consent of the individual who is nominated as an Account Manager, including appropriate consent for the collection, use and transfer of personal information to Etihad Airways for a variety of purposes outlined in the relevant privacy statements. Upon request, Etihad reserves the right to ask for such a written consent at any time.
2.1.7. Redeeming of Etihad Guest Miles can be done only by the Organisation, represented by their appointed Account Manager.
2.1.8. Etihad may accept or reject any application by an Organisation at its absolute discretion.
2.1.9. The start date of the Etihad BusinessConnect membership will be the date the Registration Form was submitted via the website. If an application is subsequently rejected, then any benefit that may have been accrued will be null and void.
2.1.10. It is the responsibility of the Organisation’s Account Manager to ensure that appropriate care is taken of the Etihad BusinessConnect account to prevent unauthorised persons from accessing the account.
2.1.11. When the Account Manager registers an Organisation into Etihad BusinessConnect, he/she will either select a secure password, or one will be supplied to him/her. This password will be used to authenticate the Organisation’s transactions performed by the Account Managers.
2.1.12. Organisation Account Managers must not disclose this password to another person.
2.1.13. The Account Manager of an Organisation is responsible for the redemption of Etihad Guest Miles and so must take appropriate measures to ensure there is no misuse of their Etihad BusinessConnect account. Etihad is not responsible for fraud or misuse by the Account Manager. It is the responsibility of the Organisation to implement controls to ensure the detection and prevention of any fraud or misuse. Etihad disclaims any and all liability including indirect and consequential damages that the Organisation may suffer due to any negligence, misconduct, abuse or any other activity of the Account Manager.
2.1.14. In the event that an Organisation’s Etihad BusinessConnect account has no flight activity for more than 2 years, Etihad reserves the right to terminate the account at its sole discretion, upon which all the accumulated Etihad Guest Miles will expire with no value.
2.1.15. The Organisation’s employees who are also a part of Etihad Guest loyalty programme in an individual capacity, will continue to accrue Etihad Guest Miles and Tier Miles and attain/maintain their own points level within the Etihad Guest programme subject to the terms and conditions of Etihad Guest programme.
2.1.16. The Etihad BusinessConnect account will automatically be awarded with Etihad Guest Miles for every flight that a member completes, provided the correct BusinessConnect account number is mentioned in the booking prior to the departure of the flight. The earnings ratio for these flights is as displayed on BusinessConnect website and is subject to change at any time without notice at the sole discretion of Etihad. Mileage earning details are also visible via the Etihad BusinessConnect earn miles table.
2.1.17. The Etihad Guest Miles credited to an Organisation’s account will be awarded on basis of the Flown Miles and Fare Choice pertaining to the ticket class booked. The Etihad Guest Miles awarded to the Organisation are subject to Etihad Guest terms and conditions.
2.1.18. Account Managers on his/her own may cancel his/her participation in an Organisation’s BusinessConnect account at any time by giving written notice to the Etihad BusinessConnect team via email at businessconnectsupport@etihad.ae. However, the Etihad Guest Miles accumulated in the participating Organisations account will remain with the BusinessConnect Account Manager and are not transferable or divisible on separation.
2.1.19. All communication regarding the Etihad BusinessConnect membership, including any promotional communication, will be sent to the Account Manager and Organisation agrees that communication to the Account Manager is deemed as communication to the Organisation.
2.1.20. An Organisation cannot have more than one Etihad BusinessConnect membership and the travelling employee cannot earn miles for more than one BusinessConnect account at any given time.
2.1.21. Etihad Airways reserves the right to monitor and audit membership and registration to Etihad BusinessConnect at any time to ensure compliance with these Terms and Conditions.
2.1.22. A Family Guest or a Family Head may also be a BusinessConnect Account Manager or belong to an Organisation’s BusinessConnect account at the same time, as long as these members are employees of this Organisation.
2.1.23. Family members connected to a Family Head account cannot be part of the Organisations’ BusinessConnect account unless the Organisation is a family run business, and the Family Guest is a bonafide employee of the Organisation under the local applicable law. Etihad reserves the right to ask for verification documents at any given time to prove the individual’s employment status with that Organisation. These verification documents may vary from market to market, at Etihad’s discretion.
2.1.24. Travellers under the age of 18 cannot earn Etihad Guest Miles to an Etihad BusinessConnect account. For the avoidance of doubt, this applies to Family businesses as well.
2.1.25. Where a BusinessConnect account number is entered in the ticket booking and the member is under the age of 18 or members are not employees of the Organisation, then Etihad reserves the right to expire and delete any Etihad Guest Miles accrued to that Organisation’s Etihad BusinessConnect account.
2.2. Cancellation of Membership
2.2.1. An Organisation may at any time cancel their registration by providing written notice to the Etihad Guest Service Centre or the Etihad BusinessConnect team at businessconnectsupport@etihad.ae. Upon receipt of the notice, Etihad will cancel the relevant BusinessConnect account and all accumulated Etihad Guest Miles in the account will immediately expire with no value. Accordingly, Organisations are reminded to carefully plan all cancellations to avoid any unintentional loss of accumulated Etihad Guest Miles.
2.2.2. Etihad retains the right to cancel an Organisation’s membership in the event of any breach of the membership Terms and Conditions or for any other reason that Etihad may consider as misuse or abuse of membership at Etihad’s discretion. Any Reward booking made by the Account Manager either before or after the date of breach will be subject to review, and possible cancellation, by Etihad.
2.2.3. After a period of 24 months of inactivity on an account, Etihad reserves the right to terminate an Organisation’s BusinessConnect membership.
2.2.4. If Etihad terminates or cancels an Organisation’s BusinessConnect Account, all accumulated Etihad Guest Miles will expire and will immediately be removed from the account.
2.2.5. Etihad has the sole discretionary right to terminate a BusinessConnect Account without any reason, including without limitation, closure of the Etihad BusinessConnect programme or a merger with another programme or any other reason. Upon termination, the Organisation will have thirty (30) days to redeem any accumulated Etihad Guest Miles, after which the accumulated Etihad Guest Miles will expire.
3. Personal Data Changes
3.1.1. An Organisation must provide Etihad with a correct mailing address and email address for an authorised officer of the Organisation and the Account Manager. If there is a change of the relevant mailing /email addresses, the Organisation should inform the Etihad BusinessConnect team in writing or via the programme website. All personal data will be handled subject to the relevant Etihad Privacy Policy. Organisation agrees and warrants that it has secured all requisite written consents for the use, collection and processing of personal data, including the consent for receiving transactional and promotional communications.
3.1.2. Changes in the membership account to Organisation’s name and the industry type are not allowed. Any other changes required to the membership must be communicated to Etihad BusinessConnect in writing and on Organisation’s letter head and with Organisation’s stamp signed by the duly appointed officer/ Account Manager.
3.1.3. From time to time, the personal data the Account Manager has furnished to Etihad may be used to offer the Members/Organisations relevant and valuable offers from Etihad BusinessConnect partners. The Organisation, on behalf of the Account Manager and Members, provides consent for such communications. If the Members/Organisation have any objection regarding use of the Organisation’s data, the Account Manager or Member may request that the data may not be used for such purposes, other than basic processing of Organisation account.
3.1.4. If more than one BusinessConnect account number has been assigned to an Organisation in error or oversight, the accounts will be combined and the Etihad Guest Miles transferred to one single account, less any duplicated bonuses or Etihad Guest Miles from the same activity. The other accounts will then be terminated.
3.1.5. This merging of accounts can be requested by the Account Manager or can be conducted at Etihad’s discretion. BusinessConnect Accounts cannot be merged with personal individual Etihad Guest, SuperSeller, CargoConnect or any other similar Etihad accounts.
3.1.6. An Organisation can change the Account Manager only once in one (1) year. Once a change to an Account Manager is made, the Organisation will be able to add a new Account Manager only after the existing Account Manager completes one (1) year in that particular role.
4. Etihad Guest Miles
4.1. Earning Etihad Guest Miles
4.1.1. Only Members are eligible to earn Etihad Guest Miles and the Account Manager, Nominated Travel Agent, or the travelling employees must quote the membership Account Number (which must match exactly the membership Account Number held in our records) at the time of booking. When Members travel with Etihad Airways, the Organisation’s account will be credited with the relevant number of Etihad Guest Miles in accordance with the BusinessConnect Mileage Earning structure for that Fare Choice and distance flown, as indicated in the Etihad BusinessConnect Mileage Earning Table. The Earning Table is determined by Etihad Airways and is subject to change at any time without notice. Retroactive claiming of Etihad Guest Miles to the Organisation’s BusinessConnect account post flight is not allowed.
4.1.2. All mileage and subsequent Rewards must be earned according to the Terms and Conditions of the Etihad BusinessConnect programme.
4.1.3. Etihad reserves the right to make Etihad Guest Miles and promotional offers available to selected organisations based on flight activity, geographic location, programme participation or information supplied by the Member.
4.1.4. Etihad Guest Miles will be issued only for flights actually flown by the Members and will be based on the class of the ticket paid for and will not reflect any complimentary upgrades.
4.1.5. Only qualifying fares on Etihad Airways flights are eligible for mileage credit. The following fare types will not qualify for mileage credit: corporate deal fares, travel industry reduced rates, free or non-revenue tickets, military or government tickets, charter flights, bus routes and any other fares that are from time to time declared by Etihad to be ineligible for mileage credit.
4.1.6. Members are not entitled to earn Etihad Guest Miles in their BusinessConnect account if they have given incorrect or incomplete traveller information at the time of booking. To ensure that as a member you are served appropriately in case of a disruption, the traveller contact information (phone number and email address) is required for every booking. From January 1, 2018 onwards, any booking without this information will be deemed ineligible, and no miles will be accrued for the transaction.
4.1.6.1. All flights marketed and operated by any other partner airline whether with or without an Etihad Airways code will not qualify for earning mileage .
4.1.7. Only the flown flights will qualify for mileage credit to the BusinessConnect account. Please check the Earning Table provided on the BusinessConnect website to see the applicable earning percentages based on Fare choice/Class. All other promotions, tier bonus, etc., for which an Etihad Guest Member is eligible will not be transferable to the account unless specifically stated in the offer at the time.
4.1.7.1. If the purchased ticket has been upgraded using the select upgrade/airport upgrade/ miles or instant upgrade option, the Etihad Guest Miles credited to the Organisation’s BusinessConnect account will be as per the original fare class and not the upgraded fare class.
4.1.8. Provided the traveller has supplied their company’s BusinessConnect Account Number information at the time of ticketing / time of check-in, mileage will be credited to the BusinessConnect Account within seven (7) days of travel.
4.1.9. Payments made for applicable taxes, fees and charges imposed by any relevant government or other authorities, or by the operator of an airport, shall not contribute to any Etihad Guest Miles accrual.
4.1.10. All Etihad Guest Miles have no cash value.
4.1.11. The validity period of Etihad Guest Miles is extendable. The validity of Etihad Guest Miles will be extended based on Qualifying member activity. A Qualifying member’s activity extends the Etihad Guest Miles validity period by 18 months.
4.1.11.1 Etihad Guest Miles will expire in the event a BusinessConnect member does not fulfil the criteria of a Qualifying Activity within a period of 18 months from the last Qualifying Activity. If a BusinessConnect member does not qualify for the extension within 18 months of the last Qualifying Activity, the miles balance will expire on the last day of the 18th month after the last Qualifying Activity, at 23:30 (GST time).
4.1.11.2 This applies to members who have spent or earned Etihad Guest Miles after 1 February 2019. For members who have not spent or earned miles since 1 February 2019, miles will expire after two years from the date that they were earned.
4.1.12. Only the Account Manager may authorise the deduction of Etihad Guest Miles or issue of Rewards from the BusinessConnect account. All Etihad Guest Miles in the Organisation’s Etihad BusinessConnect account belong to the Organisation and not to the individual. Any action by the designated Account Manager will be considered an action authorised by the Organisation and the Organisation waives all legal and moral rights to dispute any action taken by the Account Manager. It is the responsibility of the Organisation to implement controls to ensure all actions by the Account Manager are with the authorisation of the Organisation. Organisation’s Etihad Guest Miles cannot be transferred to any personal Etihad Guest account or any other account with Etihad.
4.2. Crediting Etihad Guest Miles
4.2.1. While Etihad makes reasonable attempts to provide accurate credit of mileage, it is a Member’s responsibility to retain and provide the necessary documents, such as boarding passes and tickets in the event that a retroactive credit is claimed.
4.2.2. Etihad Guest Miles are not transferable and cannot be combined with Etihad Guest Miles of any other Etihad Guest Account except as part of an Etihad Guest Family Membership. Please see Etihad Guest Programme Terms and Conditions for full details. No such ‘Family Membership’ exists for the BusinessConnect programme.
4.2.3. To be eligible for the 5,000 welcome bonus Etihad Guest Miles, two (2) eligible flights must be taken within three (3) months of Etihad BusinessConnect account registration date.
4.2.4. The 5,000 welcome bonus Etihad Guest Miles will be credited to the relevant account within ten (10) working days once the second qualifying flight has been taken, as long as these flights have been taken within three (3) months of the BusinessConnect account registration date.
4.2.5. Etihad Airways reserves the right to withdraw the promotional award of the 5,000 miles welcome bonus at its discretion and without prior notice.
4.3. Mileage Statements
4.3.1. Mileage statements will be issued to the Account Manager periodically at the discretion of Etihad. The Account Manager can also view the Organisation’s account information online.
4.3.2. Provided you have given correct BusinessConnect account information at the time of ticketing, miles eligible for accrual would usually appear on the account within seven (7) days of travel. However, in case there is an operational or technical issue, a delay can be expected until the issues are resolved.
4.4. Retroactive Mileage Claims
4.4.1. Retroactive claim of Etihad Guest Miles is not allowed after the flight is flown. It is the responsibility of the Account Manager/traveller to ensure that the Organisation’s BusinessConnect account number is mentioned in the booking prior to the departure of the flight.
4.4.2 If the BusinessConnect account number was entered correctly in the ticket booking format and where Etihad Guest Miles were not credited due to a technical error, then Etihad BusinessConnect team will review such cases and grant miles on an exceptional basis at Etihad‘s sole discretion.
5. Redeeming Etihad Guest Miles
5.1. General Redemption rules
5.1.1. All Rewards available in the Etihad BusinessConnect programme are as specified and prevalent on our website, or as per the most recent communications issued. The Rewards are subject to the terms and conditions of each Reward provider, which can be Etihad Airways, Etihad Holidays, a partner airline or a third party Merchant.
5.1.2. All Rewards are subject to availability and the Reward providers’ restrictions in the Etihad Guest Reward Shop rules. The number of Etihad Guest Miles required for a Reward is subject to change. Etihad Guest may withdraw, replace or substitute Rewards at any time without notice.
5.1.3. Account Managers may claim Rewards from the Reward Shop in accordance with the Etihad Guest Reward Shop Rules stated below either when an Organisation has sufficient Etihad Guest Miles accumulated in their Etihad BusinessConnect account or may contribute cash as part payment for Rewards, as communicated by the most recent communications issued. Etihad Guest redemption rules, prices and terms and conditions are subject to change at any time without notice.
5.1.4. To the extent permitted by law, Etihad accepts no liability whatsoever in respect of any damage, death, delay, injury or loss arising out of or in connection with the services or Rewards supplied by the Etihad or an Etihad Guest Partner, or in connection with a refusal to supply a Reward by Etihad or an Etihad Guest Partner. The Rewards supplied to a Member will be subject exclusively to the terms and conditions of the party supplying that Reward. Etihad strongly recommends that you check the terms and conditions of Etihad Airways, as appearing on the website.
5.1.5. All Terms and Conditions applicable to the Reward Shop as defined in the Etihad Guest programme are deemed applicable to the Account Manager when redeeming Etihad Guest Miles through an Organisation’s BusinessConnect account. The cost associated with applicable taxes, fees and charges imposed by any relevant government or other authorities, or by the operator of an airport that apply on a reward ticket or any other reward, shall be borne by the Organisation.
5.2. Personal Information
5.2.1. The data collection through Etihad BusinessConnect is governed by Etihad Airways Privacy Policy (here) and Etihad BusinessConnect Privacy Policy (here) as available publicly and in these Terms and Conditions under section 12. Privacy Policy. These policies shall be deemed to be incorporated by reference into these Terms and Conditions. The Account Manager agrees that by providing such information the Organisation agrees to Etihad sharing any part of that information with third party providers for purposes such as to process and complete the required transaction, analytics, reporting and marketing. Etihad shall not be liable for any wrong personal/corporate information received or obtained by the Account Manager.
5.2.2. The Organisation further acknowledges and agrees that by providing BusinessConnect with any personal or proprietary information, directly or indirectly, the Organisation consents to the transmission of such personal/corporate information over international borders and outside of the European Union (EU) as necessary for processing the relevant transactions in accordance with Etihad standard business practices and Privacy Policy.
5.3. Limitation of Liability
5.3.1. The information regarding Rewards and other services provided under Etihad BusinessConnect on the website or a linked website, may contain third party operated websites or information, and may include inaccuracies or typographical errors, and Etihad specifically disclaims any liability for such inaccuracies, errors, and representations. Other than as required under applicable laws, under no circumstance will Etihad be liable for any loss or damage caused by the reliance of any Member, Account Manager or Organisation on information obtained through our programmes.
5.3.2. The Organisation agrees that Etihad, its affiliates and any of their respective officers, directors, employers, or agents will not be liable, whether in contract, tort, strict liability or otherwise, for any indirect, punitive, special, consequential, incidental or indirect damages (including without limitation lost profits, cost of procuring substitute service or lost opportunity) arising out of or in connection with the use of the Etihad BusinessConnect Programme. This limitation on liability includes, but is not limited to, the transmission of any virus which may infect your equipment, failure of mechanical or electronic equipment or communication lines, telephone or other interconnect problems, unauthorised access, theft, operator errors, strike or other labour problems or any force majeure. Etihad cannot and does not guarantee continuous, uninterrupted, or secure access to the BusinessConnect Site.
5.3.3. Etihad reserves the right to seek all remedies available at law and in equity for any misuse of the Etihad BusinessConnect Site or the Reward Shop and/or violations of these rules, including the right to block access from a particular Internet address to the Site and to exclude you from accessing the Site.
5.3.4. The Organisation agrees that any rewards by means of miles (either deemed to be in cash or in kind) or any other reward generated through your BusinessConnect membership that may be subject to taxation in your jurisdiction is solely the responsibility and obligation of the Organisation and you should consult with your tax professional regarding your applicable taxes. Etihad bears no responsibility for any taxation obligations in any jurisdiction arising due to a BusinessConnect membership, including but not limited, to taxation payment, reporting and any other related compliance obligations.
5.4. Copy Rights/ Trademarks
5.4.1. The trademarks, logos, copyright and service marks (collectively referred to as "Marks") displayed on the Site are the property of Etihad Airways. Usage of any Marks for any purpose is prohibited including, but not limited to, the use as metatags on other pages or sites on the World Wide Web without the written permission of Etihad Airways, or such other party which may own the Marks. It is prohibited to modify, copy, distribute, transmit, display, publish, sell, license, create derivative works or using any Content available on or through the Site for commercial or public purposes.
5.5. Access to Password Protected/Secure Areas
5.5.1. Access to and use of password protected and/or secure areas of Etihad BusinessConnect is restricted to the Organisation’s Account Manager only. Unauthorised individuals attempting to access these areas of the BusinessConnect website may be subject to prosecution. The Account Manager is responsible for maintaining the confidentiality of the Organisation’s information, including the account and password, and for restricting access to its computers to prevent unauthorised access to the Site. The Organisation agrees to accept responsibility for all redemption and other activities that occur under the Organisation’s account or password. The Account Manager should take all necessary steps to ensure that the password is kept confidential and secure and should inform Etihad immediately if they have any reason to believe that their password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
6. Auditing
6.1.1. Etihad reserves the right to audit any and all Etihad BusinessConnect accounts in the programme at any time and without notice to the member to ensure compliance with the programme rules and applicable conditions of carriage and/or tariffs.
6.1.2. In the event that an audit reveals discrepancies or violations, the processing of Rewards or statement of account may be delayed until the discrepancies are resolved to the satisfaction of Etihad. If any misuse, fraud, violation of terms and conditions or any other inappropriate behaviour is discovered during the audit, Etihad reserves the unilateral right to suspend or terminate membership and expire all miles with no value.
7. Termination or Changes to Etihad BusinessConnect
7.1.1. Etihad may change the Etihad BusinessConnect rules in whole or in part, at its own sole discretion and any time without notice. However, Etihad will make all reasonable efforts to give the Organisation prior notice of the changes.
7.1.2. Etihad has the right to terminate the Etihad BusinessConnect programme at any time. Etihad will make all reasonable efforts to give you prior notice of the termination.
7.1.3. Etihad reserves the right to interpret and apply the policies and procedures communicated in these Terms and Conditions. All decisions by Etihad shall be final and conclusive in each case. These Terms and Conditions are updated from time to time and supersede all previously published Terms and Conditions.
7.1.4. Etihad in its sole judgment reserves the right to disqualify a Member or an Organisation from further participation in BusinessConnect, cancel all accumulated Etihad Guest Miles with no value and seek compensation for Rewards used if Etihad deems the member has engaged in misconduct, misuse, fraud, abuse or has breached any of the Terms and Conditions governing the programme, including but not limited to: failure to follow BusinessConnect policies and procedures, the sale or barter of Rewards or tickets, any misrepresentation of facts relating to the earning or redemption of Rewards or any other improper conduct as determined by Etihad, including but not limited to infraction of the tariffs of Etihad Airways or any BusinessConnect Partner airline participant in the programme, any untoward behaviour with reference to any Etihad employee or refusal to honour Etihad employees' instructions.
8. Law and Jurisdiction
8.1.1. These Terms and Conditions and the relationship between Etihad, the Organisation, the Account Manager and each Member are governed exclusively by the federal laws of United Arab Emirates as applied in the Emirate of Abu Dhabi. In joining the programme, the Organisation and the Member are agreeing to submit to the exclusive jurisdiction of the courts of Abu Dhabi, United Arab Emirates.
8.1.2. If in any jurisdiction, the programme, the issue of Etihad Guest Miles or the redemption of any reward is unlawful, then to the extent that the laws of that jurisdiction are applicable, the issue or redemption of Etihad Guest Miles or rewards and any related documents are void.
9. Disclaimer of Warranty and Limitation of Liability
Etihad makes no representations or warranties, either expressed or implied, with respect to the Etihad BusinessConnect Site or the contents and, to the fullest extent permissible under the law, disclaims all such representations and warranties. Your access to and use of software and other materials on, or through, the Etihad BusinessConnect Site or any third party operated websites, is solely at your own risk. Etihad makes no warranty whatsoever about the reliability, stability or virus-free nature of such software. Subject to applicable law, under no circumstance is Etihad responsible for any direct or indirect, incidental, special, punitive, exemplary or consequential damages of any kind (including but not limited to lost profits, lost savings or revenue, or loss or corruption of data or information) which arises out of or is in any way connected with your use of or inability to use the BusinessConnect Site whether based on breach of contract, tort, negligence, product liability or otherwise, even if advised of the possibility of such damages.
10. Site Availability
While Etihad Airways uses all reasonable endeavours to make the Etihad BusinessConnect Websites and associated services available, Etihad cannot guarantee that they will operate continuously or without interruption.
11. Acceptable Use Policy
When using the BusinessConnect Websites you agree:
Not to deface, alter or interfere with the front end "look and feel" of the Etihad BusinessConnect Websites or the underlying software code.
Not to take any action which will impose an unreasonable or disproportionately large load on the Etihad BusinessConnect Websites or related infrastructure.
Not to do anything which will or might damage, interfere with, disrupt access to, interrupt or impair the functionality of the material available on the Etihad BusinessConnect Websites, nor to upload any material that contains any computer viruses or other codes, files or programmes designed to interrupt, destroy or limit the functionality of any software or equipment.
Not to share passwords and account information to anybody who is not authorised to have such information.
Not to post, distribute or otherwise upload any defamatory, libellous, offensive, infringing, obscene, indecent, harmful, threatening, abusive, tortuous, racially or ethnically objectionable or otherwise unlawful material or information or send any chain letters, junk mail, 'spamming' material or any other form of bulk communication.
Not to threaten, harass, stalk, abuse, disrupt or otherwise violate the rights of others, including individuals' privacy rights.
Not to obtain or attempt to obtain unauthorised access to the Etihad BusinessConnect Websites or any private or member account areas on the Etihad BusinessConnect Websites, nor to impersonate any person or misrepresent your affiliation with another person.
Not do cause or permit anything to be done that may infringe, damage or interfere with any intellectual property rights of Etihad nor any of our associated companies or third parties. Also, not to do anything that is otherwise unlawful or which may create any liability on the part of Etihad.
Violate this Agreement or any applicable legislation in any other manner.
If Etihad considers that you have breached any of these terms and conditions or have otherwise demonstrated inappropriate conduct when using Etihad BusinessConnect Websites, Etihad reserves the right to:
Warn you that you have breached these terms and conditions, and ask you to stop such conduct;
Delete any material or content which you may have posted without notice to you;
Take measures (including terminating, suspending or restricting your access) to, and preventing you from using the Etihad BusinessConnect Websites;
Terminate your Etihad BusinessConnect membership and immediately expire all earned Miles;
Report your activities to an internet service provider or relevant authorities;
Take legal action against you.

14. Definitions
In the above Terms & Conditions, unless the context otherwise requires:
"Etihad Airways" means the national airline of the United Arab Emirates established by Emiri Decree in the Emirate of Abu Dhabi and having its principal place of business at New Airport Road, P.O. Box 35566, Abu Dhabi, United Arab Emirates.
“Etihad Guest” means the programme developed and offered by Etihad Airways to reward its members who frequently travel on Etihad Airways or with airlines that are Etihad Guest Partners and to reward members using qualifying services/products of non-airline Etihad Guest Partners.
“BusinessConnect” and “Etihad BusinessConnect” are used interchangeably and mean the programme developed and offered by Etihad Airways to reward organisations who frequently travel on Etihad Airways.
“Organisation” means a corporate entity that seeks to participate in the BusinessConnect programme.
“Travel Agency” means any organisation that acts as an intermediary between Etihad Airways, and a Guest and/ or Member and provides travel related services.
“Account Manager” means the officer duly appointed by the Organisation to manage, maintain (enrolment/termination) in the BusinessConnect programme.
“Member” means any guest of Etihad Airways, who is an employee of the Organisation.
"Etihad Guest Partners" means an airline or a non-airline entity participating in the Etihad Guest programme whose qualifying services/products would earn Etihad Guest Miles, when purchased, as specified in the most recent Etihad Guest communications issued.
"Reward" means the benefit a member acquires through the Etihad Guest programme by redeeming Etihad Guest Miles in accordance and as specified in the most recent Etihad Guest communications issued.
"Etihad Guest Miles" (including miles, mileage) means all Etihad Guest Miles earned by travelling on qualifying Etihad Airways flights, qualifying flights of Etihad Guest Partners and by purchasing their products and services in accordance with and as specified in the most recent Etihad Guest communication issued.
"Etihad Guest Services Centre" means any service unit identified in the Etihad Guest communications as fully authorised and equipped to provide the requisite range of services offered under the Etihad Guest programme.
“Reward Shop” means an online platform through which Etihad Airways makes available certain Rewards which Etihad Guest Members may redeem against Etihad Guest Miles in accordance with the following four redemption types: Buying, Donating, Raffle and Bidding as per Etihad Guest Reward Shop rules.
“Site” means the BusinessConnect website that holds the registration and details on the programme.
